1. Agreement to Terms
By accessing the aB Labs platform or engaging digital design, software engineering, branding, or website optimization services from aB Labs ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access our website or commission our services.
2. Service Plans & Delivery Structures
We provide three standardized project execution and maintenance tiers:
- Growth Partner Plan ($50 setup + $150 AUD/mo): A fully managed design, development, and hosting engine. Includes custom domain setup, ongoing content/design updates, high-speed edge hosting, and full intellectual property & codebase handover after 6 continuous months.
- Complete Build ($500 AUD one-off + $50/mo hosting): Turnkey bespoke digital development offering 100% full asset, design, and code ownership from Day 1 of final launch.
- Lite Showcase ($0 Free Plan): Single-page showcase site deployed on a provider subdomain (e.g. Vercel/Netlify) with integrated lead forms for early-stage validation, with no monthly commitment.
3. Client Responsibilities & Turnaround SLA
To maintain our rapid delivery timelines (typically 2–3 business days for core builds), clients agree to provide necessary assets (logos, high-res imagery, copy, domain registrar access, and third-party integrations) in a timely manner. Timelines commence once all required inputs are verified by our team.
4. Intellectual Property & Code Ownership
We believe in client sovereignty:
- Complete Build: You own 100% of the custom frontend codebase, graphic deliverables, and copy upon full payment of the project invoice.
- Growth Partner: You hold full operational usage rights immediately; complete repository transfer and standalone ownership transition occur after 6 consecutive months of active subscription.
- Portfolio Showcase: Unless explicitly restricted by an NDA prior to kickoff, aB Labs reserves the right to showcase non-confidential screenshots and case studies in our design archive.
5. Payment Schedules, Invoices & Subscriptions
One-off projects operate on a 50% initiation deposit / 50% completion structure before final production deployment. Subscription and recurring care plans are billed monthly in advance. Failed or overdue payments may temporarily pause maintenance updates and edge deployment pipelines until settled.
6. Cancellation & Notice Periods
Monthly subscription plans operate month-to-month with no long-term lock-in contracts. You may cancel at any time by providing written notice before your next monthly billing cycle begins.
7. Limitation of Liability
To the maximum extent permitted under Australian Consumer Law and relevant local jurisdictions, aB Labs is not liable for indirect, incidental, special, or consequential damages resulting from third-party server outages, third-party API changes, or business losses. Our aggregate liability is limited to the fees paid by the client for the specific deliverable under dispute.
